On TV recently, there was mention of a case in which some parents visited
friends and left their 3 year old boy in the car together with their
friends' 3 year old boy.

Child A picked up a jack which was in the car and proceeded to beat child
B severely, to the extent that B had to be taken to A&E at the local
hospital and receive stitches and other treatment.

A also managed to break the windscreen of the car. We all know how tough
windscreens are so he must have beeen a strong lad.

The parents of child B are now applying for compensation from our Criminal
Injuries Compensation Association. I suspect that the CICA is a new name
for the former Criminal Injuries Compensation Board; government bodies are
always changing their names, I don't know why.

Should they be successful, the parents of B will be paid a lot of money at
taxpayers' expense.

In the past we have had discussions about the law of Doli Incapax, lit:
incapable of causing pain. In UK law, this means that a child, defined as
being under 10, cannot be prosecuted as they do not realise when they are
causing damage or injury, up to and including murder. Therefore they can
get away with anything.

The CICA (CICB) pays out money to the victims of crime but as child A, by
definition, is incapable of commiting a crime, then there has been no
crime. Therefore, there can be no pay out to the parents of child B who
have applied for restitution using a firm of "No Win no Fee" lawyers.

I get the feeling that parents of A are just trying to get money from the
state, i.e. us, the taxpayers.

I am curious to see what the outcome will be.

As for child A, the TV report only said that he is no longer with his
parents - it didn't say why.

There is an old saying "The Law is an Ass". Do I hear the sound of braying
?
