Tony, our laws are different in this state.
The person who wants to create a development must apply for planning
consent from the local City Council. The project is advertised, a notice
informing people of the proposal is put up in a prominent place at the
site, and neighbours, if any, are informed and invited to comment. The
pros and cons are then considered, and usually the  result makes most
people reasonably happy. City zoning also has a say in the matter. You
can't build in a zone which is not nominated in the Planning Regs. The
site has to be rezoned and again this has to be advertised in the same
way.The Planning Regulations are formulated under the Government Acts on
Planning and Infrastructure.It takes an Act of Parliament to change that.

It just underlines the fact that commentators from overseas must realize
that each state has different laws and only certain of them can be
overridden by the Commonwealth

the application for a permit". The excuses are numerous and varied such as
the trite phrases "business in confidence" or "others knowing about my
plans will cause me loss" but all boil down to some very obnoxious
polluting businesses being set up in what are effectively residential
areas with the permit being issued under the pretext of "no public
opposition was voiced".

This has even extended to the record of evidence in tribunal and court
cases being suppressed on often quite spurious grounds.

This state of affairs has been compounded by surreptitious changes in
legislation rezoning Melbourne's famous green wedges (thousands of
hectares of land zoned for park like activities)  into light industrial.
Light industrial of course allows chemical plants, tips, quarries of all
types, and similar enterprises.
